Except to the extent expressly set forth otherwise in a separate signed agreement between you and Lizzyography, all interactions and transactions with Lizzyography are, to the extent applicable, subject to the following terms and conditions:

Commercial Photography Agreement

All Lizzyography commercial photography services are subject to the Master Commercial Photography Agreement.

Course Content

You acknowledge, understand, and agree that the content presented in Lizzyography courses, classes, workshops, masterminds, mentoring sessions, or any other presentation or setting, whether live or pre-recorded (collectively “Course Content”), is the intellectual property of Lizzyography or, if applicable, Lizzyography’s licensor(s); that Lizzyography or Lizzyography’s licensor(s), if applicable, exclusively own(s) the copyright thereto; and that to the extent that you have purchased the right to download or otherwise access Course Content, such purchase shall be understood to be, and shall be, a limited, non-exclusive, non-transferable license to you to personally view (or otherwise have personal access to) the Course Content for whatever time period identified on such Course Content, if any. You further agree that you will not at any time copy, distribute, sub-license, or in any way grant unauthorized access to the Course Content.

To the extent that your attendance or participation in the creation or production of Course Content results in Lizzyography’s use or incorporation of any statement, images, ideas, or other content provided by you (collectively, “Feedback”), you hereby grant to Lizzyography a worldwide, irrevocable, non-exclusive, right and license to use and reproduce such Feedback in any Course Content.

All purchases of Course Content (via this website or otherwise) are non-refundable.

WITHOUT IN ANY WAY LIMITING THE GENERALITY OF THE FOREGOING, LIZZYOGRAPHY DOES NOT REPRESENT OR WARRANT THAT THE COURSE CONTENT WILL MEET THE REQUIREMENTS OF ANY PERSON AND LIZZYOGRAPHY MAKES NO OTHER REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OR REPRESENTATIONS CONCERNING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF ANY PORTION OF THE COURSE CONTENT. YOU ACKNOWLEDGE AND AGREE THAT THE COURSE CONTENT AND ARE NOT INTENDED TO BE STATEMENTS OF FACT OR TRUTH. LIZZYOGRAPHY ASSUMES NO RESPONSIBILITY FOR THE ACCURACY, UP-TO-DATE STATUS, OR COMPLETENESS OF THE COURSE CONTENT.

YOU ACKNOWLEDGE AND AGREE THAT LIZZYOGRAPHY AND ITS VENDORS AND LICENSORS DO NOT OPERATE OR CONTROL THE INTERNET AND THAT: (A) VIRUSES, WORMS, TROJAN HORSES, OR OTHER UNDESIRABLE DATA OR SOFTWARE; OR (B) UNAUTHORIZED USERS (E.G., HACKERS) MAY ATTEMPT TO OBTAIN ACCESS TO AND DAMAGE YOUR COMPUTERS, NETWORKS, OR DATA IN CONNECTION WITH YOUR ACCESS TO COURSE CONTENT. LIZZYOGRAPHY WILL NOT BE RESPONSIBLE FOR SUCH ACTIVITIES.

On-site Activities Waiver & Release

To the extent that you or your minor child participates in any On-site Activities, then you hereby agree, on behalf of yourself and/or on behalf of your minor child, that any and all such participation shall be subject to the following terms, conditions, and release. “On-site Activities” means (i) any in-person meeting or interaction with Lizzyography or any of its owners, officers, directors, employees, or consultants (the “Released Parties”), or (ii) your physical presence on property which is owned, rented, leased, or under the control of a Released Party (the “Property”).

Assumption of Risk. You understand that your participation in On-site Activities may expose you to risks of serious physical, emotional, and mental injury and stress. You also understand that the Property as well as other On-site Activities locations (each a “Location”) may be dangerous and may expose you and other participants of the On-site Activities (each a “Participant”) to a variety of hazards. You understand that your participation in the On-site Activities, your presence when they are occurring (whether or not you are actively participating in them), and the features of some of the Locations themselves may carry with them the risk of death, serious physical injury, extreme emotional distress, severe physical, mental and emotional stress, mental and physical illness, non-consensual physical contact, and loss of personal property. You understand these risks and acknowledge that while conduct that gives rise to such situations might otherwise constitute an actionable tort or give rise to other claims or causes of action, you have freely consented to such conduct, have assumed the risks thereof, and hereby waive all claims related thereto. You understand that Lizzyography, directly or through others, may provide equipment in connection with the On-site Activities. You acknowledge that Lizzyography has made no warranties whatsoever with respect to any such equipment and that, as between Lizzyography and you, there are no warranties of any kind regarding fitness or suitability for use of any such equipment for any purpose. You hereby waive any right you otherwise might have to warnings or instructions regarding any aspect of the On-site Activities or any equipment utilized in connection with the On-site Activities. You also understand that the use of any such equipment involves risk and you agree that you will use such equipment only at your own risk. You also understand and acknowledge that Lizzyography has made no representation or warranty of any kind regarding my qualifications, ability, or fitness to participate in the On-site Activities.

RELEASE & COVENANT NOT TO SUE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY IRREVOCABLY COVENANT NOT TO SUE OR MAKE ANY CLAIM OR ALLEGATION OR INSTITUTE ANY OTHER LEGAL PROCEEDING WHATSOEVER AGAINST THE RELEASED PARTIES FOR ANY INJURY, ILLNESS, DAMAGE, LOSS, DEATH, OR HARM TO YOU OR YOUR PROPERTY IN CONNECTION WITH, OR IN ANY WAY RELATED TO THE ON-SITE ACTIVITIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU IRREVOCABLY RELEASE EACH OF THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, ACTIONS, DAMAGES, INJURIES, LIABILITIES, LOSSES, COSTS AND EXPENSES OF ANY KIND OR NATURE WHATSOEVER (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES AND COSTS) SUFFERED BY YOU, DIRECTLY OR INDIRECTLY ARISING OUT OF, RESULTING FROM, OR BY REASON OF YOUR PARTICIPATION IN OR IN CONNECTION WITH THE ON-SITE ACTIVITIES, INCLUDING WITHOUT LIMITATION, ANY TRAVEL YOU UNDERTAKE IN CONNECTION THE ON-SITE ACTIVITIES, ANY DEFECT OR FAILURE OF EQUIPMENT, YOUR DECISION TO FOLLOW OR FAILURE TO FOLLOW THE ADVICE, WARNINGS, OR INSTRUCTIONS OF LIZZYOGRAPHY OR ANYONE ELSE CONNECTED WITH THE ON-SITE ACTIVITIES, ON ANY LEGAL OR EQUITABLE THEORY WHATSOEVER (INCLUDING WITHOUT LIMITATION NEGLIGENCE, INFLICTION OF EMOTIONAL DISTRESS, BREACH OF EXPRESS OR IMPLIED CONTRACT, PRODUCT LIABILITY, PERSONAL INJURY, OR WRONGFUL DEATH).

YOU HEREBY WARRANT THAT YOU ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AND HAVE THE RIGHT TO CONTRACT IN YOUR OWN NAME AND, AS APPLICABLE, ON BEHALF OF YOUR MINOR CHILDREN. YOU HAVE READ AND UNDERSTAND THE FOREGOING PROVISIONS PRIOR TO PARTICIPATING IN THE ON-SITE ACTIVITIES. FURTHERMORE, YOUR REPRESENT AND WARRANT THAT YOU HAVE HAD AMPLE OPPORTUNITY TO READ, AND HAVE IN FACT READ, UNDERSTOOD AND AGREED TO, THIS ENTIRE RELEASE. YOU FULLY UNDERSTAND THE RELEASES YOU HAVE MADE HERIN. MOREOVER, YOU UNDERSTAND THAT YOU ARE GIVING UP CERTAIN LEGAL RIGHTS UNDER THIS RELEASE.
